Booking Terms and Conditions

Effective Date: March 8th, 2024

Welcome to Portugal Uncovered, Lda, hereinafter referred to as Portugal Uncovered. These Booking Terms and Conditions ("Booking Terms") govern all bookings made through our website, mobile application, or any other platform provided by Portugal Uncovered ("we", "us", "our"). By making a booking, you agree to be bound by these Booking Terms, our Terms of Use, and our Privacy Policy. Please read these documents carefully.


1. Making a Booking

To make a booking through Portugal Uncovered, you must be at least 18 years old and possess the legal capacity to enter into binding contracts. All bookings are subject to availability and confirmation by us.


2. Payment

We accept payment via a payment link to be sent to the customer. By providing payment details, you warrant that you are authorized to use the payment method.

We request the payment of the planning fee upfront. After confirmation of the itinerary, we request a payment of 50% of total cost in advance to secure your booking. We will only book with the service providers after payment confirmation by our bank. Please have in mind that if this process takes too long some of the services may not be available anymore. The rest of the payment should be made four weeks prior to arrival date. If we do not receive this final payment we will consider the reservation as canceled and the cancellation policy applies. 


3. Prices and Fees

All prices are displayed in USD reflecting an underlying price in EUR and include VAT. Prices are subject to change until the booking is confirmed. Additional fees may apply for changes or cancellations.


4. Changes and Cancellations

You may change or cancel your booking subject to the following conditions:

  • Changes: If you wish to change your booking, please contact us as soon as possible. Changes may incur additional charges.

  • Cancellations: Cancellations must be made 5 days prior to the departure date, unless otherwise stated, to be eligible for a full or partial refund. Cancellations made after this period may not be refunded.

5. Refunds

Refunds, where applicable, will be processed to the original payment method within [specify time frame, e.g., 30] days. Some bookings may be non-refundable as specified at the time of booking.


6. Travel Insurance

We strongly recommend that you purchase comprehensive travel insurance to cover any unforeseen circumstances that may affect your travel plans.


7. Warranty

Under the terms of the current legislation the responsibility of the agency is guaranteed by a liability insurance of the company Companhia de Seguros Allianz Portugal, S.A., with the number 207065223 for the amount of € 75,000.00. The company also contributed to the Travel and Tourism Guarantee Fund (FGVT - DL 61/2011 of 06 May with the wording given to it by DL 199/2012 of 24 August). The grounds for excluding Portugal Uncovered from liability include, but are not limited to, the speculative, false or fraudulent reservation made by the customer, cancellation of the trip by the customer, faults in the execution of the agreement attributable to the client, faults imputable to a third party alien to the provision of the services envisaged, faults which are unforeseeable and unavoidable and situations due to force majeure. 


8. Liability

Portugal Uncovered acts as an agent for third-party providers of travel services and is not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any such providers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.


9. Special Requests

Any special requests must be made at the time of booking. While we will strive to accommodate special requests, they cannot be guaranteed.


10. Documentation

You are responsible for ensuring that you have all necessary travel documents, including passports, visas, and health certificates, and for complying with all laws, regulations, orders, and travel requirements of destinations involved in your travel itinerary. Any inconvenience caused by any failure in travel documentation is the participants’ responsibility. It is advised to consult the embassy or consulate of Portugal in your home country. In no case may Portugal Uncovered be liable, directly or indirectly, for the refusal of being granted a visa or getting permission to enter any country.


11. Unused services 

No refunds or exchanges can be made with respect to accommodation, meals, sightseeing tours, transport or any other services, included in the tour/activity price after the tour has started. If you do not use some of the services that you have paid for, for any reason during the tour no refunds will be made.

 

12. Complaints

If you have a complaint about any aspect of your booking, please contact us immediately so we can attempt to resolve the issue.


If you have a complaint about a service during your holiday please refer the matter to the supplier service provider immediately (hotel, car hire, driver etc). Matters can most easily be resolved by you on the spot, when the supplier can see and understand the exact nature of any occurring problems that you may have. It is unreasonable to take no action whilst on holiday, and then complain afterwards. If in the unlikely event that matters cannot be resolved to your satisfaction, we will ask you to record details and you must then follow up your report by writing to our Customer Service Department. Please note that we will not accept complaints that have not been previously made to the supplier.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Portugal and will submit to the courts of Lisbon, without regard to its conflict of law provisions.


14. Amendments

We reserve the right to amend these Booking Terms at any time. The most current version of the Booking Terms will supersede all previous versions.
